PRAYER :- For Bail in Crime No.48 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/3rd Accused herein, who was arrested on 26.05.2023 for the alleged offence under Sections 302 of IPC @ 302, 109 and 201 of IPC, in Crime No.48 of 2023, on the file of the respondent police, seeks bail. 1/4
2.The case of the prosecution is that the defacto complainant lodged a complaint before the respondent police stating that on 26.05.2023, at about 6.15 a.m., his wife informed him that the deceased was lying dead on the Idaikattur to Periyakottai Main Road. He along with his wife and son went to that place and found the deceased with severe injuries on head region along with his bike, which was damaged. Hence, the case.
3.The learned Additional Public Prosecutor would submit that on the basis of the above said complaint, investigation was undertaken. During the course of investigation, involvement of the petitioner came to light. Hence, he was arrested and remanded to judicial custody.
4.Seeking bail this petition has been filed stating that this petitioner is only friend of the first accused and he is not involved in the above said occurrence. 5.Reading of the CD file shows that this petitioner also appears to be the friend of the first petitioner. On previous occasion, the accused persons conspired and involved in robbery. In respect of the robbery, Crime No.71 of 2023 was registered. 6.This petitioner was included in the present case after coming to know about the involvement. The gruesome manner, in which, the above said murder said to have been committed, dis-entitles the petitioner from claiming bail at this stage. Considering the gravity of offence, this Court is not inclined to grant bail to the 2/4
