This Criminal Original Petition has been filed to direct the second Respondent to give adequate police protection to the life and limb of the 1/4
Petitioner and his family members, on the basis of his representation dated 03.06.2022.
2.It is the submission of the learned Counsel for the Petitioner that the Petitioner had given a representation dated 03.06.2022 to the second Respondent seeking police protection. However, the second Respondent did not consider the same so far and had not passed any orders. It is the further submission of the learned Counsel for the Petitioner that the accused person threatened the Petitioner stating that if he will not withdraw the complaint, they will kill him.
3.The learned Government Advocate (Crl.side) for the Respondents submits that the case was registered in Crime No.153 of 2022 for the offences under Sections 417 and 420 IPC against the accused person. It is the submission of the learned Government Advocate (Crl.side) that the Petitioner was called for enquiry over phone, but he did not appear for the same and had not cooperated with the investigation. 2/4
4.The apprehension expressed by the Petitioner is found justified, considering the fact that based on the complaint of the Petitioner and other similarly placed persons, the Police had not taken action. Only after obtaining directions from this Court, the FIR had been registered. 5.In the light of the above, the Respondents are directed to protect the complainants from unwarranted threat held out by the accused, who had embezzled the unemployed youth to the tune of several lakhs of rupees under the guise of getting them employment. Only after affording them protection, the Petitioner and other similarly placed persons will be able to appear before the second Respondent. The Petitioner is directed to cooperate with the pending investigation.
