ORDER

Seeking to quash the First Information Report in Crime No.1133 of 2020 on the file of the first respondent, the present Criminal Original Petition has been filed.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The learned counsel for the petitioner submitted that the date of the alleged offence is 24.09.2020 and that the offences alleged are under Sections 5 and 7(3) of the Lotteries Regulation Act, 1998. Despite the expiry of the period of limitation, the charge sheet has not been laid within time and on that ground, the First Information Report is liable to be quashed.

4. Mr.S.Ravi, learned Additional Public Prosecutor, on instructions, submitted that the charge sheet was filed on 18.09.2024 before the learned Judicial Magistrate No.5, Trichy.

5. Precisely marking that the said exercise has been done after the limitation period, I am not hesitant in quashing the First Information Report. 2/4

6. Accordingly, the First Information Report in Crime No.1133 of 2020 on the file of the first respondent police is hereby quashed, and this Criminal Original Petition is allowed. Consequently, the connected Criminal Miscellaneous Petition is closed.
