For Anticipatory Bail in Cr.No.15 of 2025 on the file of the Respondent Police.
ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 465, 467, 468, 471, 120(B) of IPC, in Crime No.15 of 2025, on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the defacto complainant was the partner of a partnership firm namely M/s. Ramm Construction, containing of the 1st petitioner and the defacto complainant. The de-facto complainant has invested Rs. 1,21,77,232/- by availing loan from the bank and money lenders. The the de-facto complainant admitted at hospital due to heart attack. The 1st petitioner removed the de-facto complainant from the partnership firm by forging the de-facto complainant's signature and included the 2nd petitioner who is the wife of the 1st petitioner. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioners.
3. On 21.11.2025, this Court has granted anticipatory bail to the petitioners 2 and 3 and referred the matter to the medication centre in respect of the first petitioner alone.
4.The learned counsel appearing for the first petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the first petitioners. 5.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the first petitioner are serious in nature.
6.The learned Counsel appearing for the intervenor vehemently objected for granting anticipatory bail stating that the first petitioner has forged the partnership firm as well as registered a release deed.

Considering the facts and circumstances of the case and also the fact that the investigation has been almost completed, this Court is inclined to grant anticipatory bail to the first petitioner, subject to certain conditions. 8.Accordingly, the first petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the first petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that:
[a]the first petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;
[b] the first petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks as and when required for interrogation;
[c]the first petitioner shall not tamper with the evidence or witness either during investigation or trial. [d]the first petitioner shall not abscond either during investigation or trial.
[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the first petitioner in accordance with law as if the conditions have been imposed and the first petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
