ORDER

The Writ Petition is filed seeking a direction to the third respondent to cancel the patta issued in the name of the private respondents 5 and 6 and issue patta in the name of the petitioner in respect of the property situated in Survey Nos.70/1 and 70/2 in Nadupatti Village, Manaparai Taluk, Trichy District, by considering his representation dated 14.10.2024.

2. Heard the arguments of Mr.G.Gomathisankar, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional 2/6

Government Pleader, who takes notice for the respondents 1 to 4. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, the private respondents are claiming right over the subject property under various registered documents mentioned in the representation. The registered documents relied on by the private respondents are fraudulent documents. Therefore, he submitted a representation before the third respondent seeking cancellation of the registered documents and consequential order for cancellation of the revenue documents, which were issued based on the registered documents. The same has not been considered. Hence, the petitioner has come before this Court.

4. Even as per the averments of the petitioner in the representation submitted by him, the private respondents are claiming right over the property under registered documents. The Revenue Officials are not entitled to decide about the fraudulent nature of the registered document. Unless the petitioner gets a declaration from the civil Court with regard 3/6

to the invalidity of the registered documents, the Revenue Officials may not be in a position to ignore those registered documents and cancel the patta issued to the private respondents based on the registered documents. In such circumstances, this Court is not inclined to issue any direction to the respondents to consider the representation of the petitioner. Accordingly, this Writ Petition stands dismissed with liberty to the petitioner to workout his remedy before the competent civil Court. No costs.
