Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to direct the respondents 1 to 8 to consider the Petitioner's representation dated 30.06.2025 and to take appropriate action as against the respondents 9 and 10 for illegally running the hallow block manufacturing unit and welding workshop unit in the name and style of Sri Ram Company and Emaraj Welding works in the residential area of Karavilai, Nattalam Village, Kanyakumari District and to close the same and ensure the safety and hygienic environment.

ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Special Government Pleader for the respondents 1, 3, 4, 6 to 8 and the learned Government Advocate for the fifth respondent and dispensing with the notice on the respondents 9 and 10 as no adverse orders are proposed to be passed at this stage.

It is specific case of the petitioner that the private respondents 9 and 10 herein are carrying out an industrial activity, namely, manufacturing of hallow block unit and welding workshop unit without obtaining necessary permission from the statutory Authority and obtaining licence for the same. 3/7

3. It is submitted by the learned counsel for the petitioner that the activity of the private respondents is causing nuisance to the petitioner.

4. It appears that the petitioner had earlier sent a representation to the second respondent/District Environment Engineer on 19.01.2023.

5. It is submitted by the learned counsel for the petitioner that the second respondent also conducted field inspection and found that the private respondents were running the manufacturing units without obtaining permission and the same was forwarded to the fifth respondent to take action against the private respondents.

6. It is further submits that the fifth respondent had also issued a notice to the private respondents 9 and 10 on 17.04.2023, however, no action has been taken so far.

7. Considering the same, I am inclined to dispose of this Writ Petition by directing the Official respondents 1 to 8 to act on the petitioner's representation, 4/7

dated 30.06.2025 as expeditiously as possible within a period of six (6) weeks from the date of the receipt of a copy of this order. Needless to state, private respondents 9 and 10 shall also be heard, before proceeding and passing such orders.
