COMMON ORDER The issue involved in all the Writ Petitions is one and the same and therefore, they are heard together and disposed of by way of this common order.

2.The petitioners were appointed as Secondary Grade Teachers in various Panchayat Union Primary Schools. The post of Secondary Grade Teachers is governed by the Special Rules for the Tamil Nadu Elementary Educational Subordinate Service Rules [hereinafter referred to as ''the Rules'']. As per Rule 9 of the Rules, each Union is a separate Union for the purpose of seniority and the seniority is maintained in Union level as per the said Rule. The respondents published seniority list of Secondary Grade Teachers in respect of Union as on 01.01.2019 and placed the petitioners' name in the seniority list below their juniors in the Union level and shown the petitioners as surplus.

3.In case of deployment, it is the usual practice that the junior-most teachers will be deployed to needy Schools. As per Rule 9 of the Rules, it is only the junior-most teachers will be deployed in the event of surplus or any other method. The first respondent, 68/82

by G.O(1D)No.270, School Education Department, dated 10.07.2012, issued guidelines in regard to deployment due to surplus. Clause 2 reads that for the purpose of deployment, seniority in the Union level should be adhered to, which is in accordance with Rule 9 of the Rules. The said Government Order is still in force. While so, the first respondent, by G.O(1D)No.217, School Education Department, dated 20.06.2019, issued instructions for the purpose of deployment. As per Clause 4(I)(i) of the said Government Order, for the purpose of deployment, station seniority is being followed, namely, School level seniority should be considered. The said Clause is contrary to Rule 9 and the Government Order cannot overlook the statutory provision. As far as elementary level is concerned, only Union level seniority is maintained and station seniority is not maintained.

4.Deploying the teachers of station seniority is illegal and violative of the Rules. The Teachers working in the elementary level are governed by the Special Rules for Tamil Nadu Elementary Educational Service Rules, issued in G.O.Ms.No.1383, Education(PUSI) Department, dated 23.08.1988, in exercise of the power conferred by Provision to Rule 309 of the Constitution of India. 5.Generally, junior-most teacher would be deployed. Even if a senior Teacher is rendered surplus, he/she would be posted in the place of junior, who in turn, would be deployed. If the Teachers, who are now working in their respective Schools, are deployed, the continuity of teaching method would be disturbed and would not be favour to Students.

For that reason only, the question of deployment would arise at the completion of academic year and generally, the Teachers are deployed only in the month of May. It is also the policy of the first respondent not to disturb the Teachers in the middle of the academic year having regard to the welfare of the Students at large. If senior Teachers are deployed, their promotion would be affected, when their turn comes. Clause 4 (I)(i) of the impugned Government Order is contrary to Rule 9 of the Rules and station seniority is not maintained. The seniority is a civil right and it cannot be followed on the basis of any executive instructions. There is no Service Rule for LKG/UKG Classes are concerned and it is not known as to how they are deployed notwithstanding the petitioners' seniority.

6.Consequent to the impugned Government Order, deployment counseling took place and the third respondent, by his impugned proceedings dated 30.08.2019, has deployed the petitioners to another Union.

7.The respondents ought to have seen that each Union is separate unit and through the impugned proceedings, the petitioners are deployed, while more juniors are available in the petitioners' Union.

8.In addition to the above contentions, the learned counsel appearing for the petitioners in the Writ Petitions separately contended that the issue involved is whether Union wise seniority should be followed or School/Station seniority should be followed while effecting deployment. The learned counsel appearing for the petitioners contended that as per Rule 9 of the Rules, Union seniority to be considered. There is no justification in the impugned Government Order and it is arbitrary. Newly appointed teachers are protected, whereas senior teachers are disturbed. If there is Union list, this will easily be avoided. 9.Mr.S.Louis, learned counsel appearing for the petitioners submitted that for more than 25 years, Union seniority was followed. When there are two teachers, there will not be any surplus.

When senior teachers are deployed in other Unions, they are placed at bottom of seniority list in the said Union and due to present system as per G.O.(1D)No.217, School Education Department, dated 20.06.2019, senior teachers are affected. Only after preparing Union list of surplus teachers, deployment must be made. The teachers are not given any opportunity to participate and choose a place of their choice for posting. In Promotional and General Transfer Counseling also, new criteria of three years of station seniority is fixed, which is stayed and modified subsequently. Senior-most teachers will face difficulties and promotional avenue are affected.

10.Mr.T.Pon Ramkumar, learned counsel appearing for the petitioners contended that G.O.(1D)No.217, School Education Department, dated 20.06.2019, is totally against the Rules. When senior-most teachers are deployed in other Union, it is not possible to maintain lien in parent Union. If teachers participated in General Counseling, they have to wait for three years in the General Transfer Counseling.

11.Mr.S.Palani Velayutham, learned counsel appearing for the petitioners submitted that the petitioners' request for transfer on the ground that his spouse is working in the same Union was not taken into consideration.

12.Mr.V.Panneer Selvam, learned counsel appearing for the petitioners submitted that the Rules enacted for maintaining seniority and preparation of Panel. Earlier, Union level seniority is maintained and now only, School wise seniority is maintained for the purpose of deployment. For the purpose of promotion, Union level seniority is to be prepared, objections are to be called for and promotions are to be made. It is not possible calling for objections from the teachers deployed in other Unions. The learned counsel further contended that when a teacher is transferred to another Union, the Service Register has to be transferred to other 70/82

Union. Block Educational Officer is the authority to sanction monetary benefits. When Service Register is transferred to other Union, the seniority and all other benefits go to other Union. If there are 75 Students, there is a possibility of maintaining three teachers. After introduction of LKG and UKG, Students strength is increasing. In W.P.(MD)No.19632 of 2019, six teachers are requested as on today, but only the petitioner is deployed to another Union instead of retaining.

13.Mr.G.Karnan, learned counsel appearing for the petitioners submitted that G.O.(1D)No.217, School Education Department, dated 20.06.2019, cannot override Statutory Rules. There is no clarification as to how transfer is to be effected after deployment. 14.Mr.C.Mayilvahana Rajendran, learned counsel, appearing for the petitioner in W.P.(MD)No.19370 of 2019 submitted that no deployment is required, as there are 61 Students and there is no surplus Teachers. In W.P.(MD)No.20126 of 2019, only deployment alone is challenged, as the fifth respondent is junior to the petitioner, but the petitioner is transferred. 15.Mr.S.Chandrasekaran, learned counsel appearing for the petitioners submitted that as per the Right of Children to Free and Compulsory Education Act, 25% of the Students are given free admission. In view of the same, the Students strength is decreasing and deployment order should be annulled.

16.Mr.P.P.Alwin Balan, learned counsel appearing for the petitioner adopted the arguments of others.

17.The respondents filed counter affidavit and the learned Special Government Pleader appearing for the respondents contended as follows:- (i) The impugned Government Order is issued mainly on the welfare of the Students, betterment of the Teachers and improvement of the School Education System. The Government is implementing many welfare schemes for providing education to the Students studying in the Government Schools, but the Students strength is decreasing especially in Panchayat Union Primary Schools and Panchayat Union Middle Schools. In view of decrease in strength of Students, some of the Teachers in some Schools are excess, while in some Schools, there are vacancies. The excess Teachers are paid salary from the Central and State Government funds without doing work, while in some Schools Students suffer for want of Teachers.

(ii) The Government issued G.O.(1D)No.217, School Education Department, dated 20.06.2019, explaining the process to be taken in conducting deployment counseling, the Elementary School Education Department conducted departmental counseling balancing the StudentsTeachers ratio for the welfare of the Students with utmost care for the Government Teachers that they will not be affected either way.

In some of the Districts, there are number of posts vacant in the cadre of Primary and Middle School Teachers in the academic year 2019-2020 and the Students faced hardships in their educational growth.

(iii) G.O.(1D)No.217, School Education Department, dated 20.06.2019, is not contrary to Rule 9 of the Rules. The sixth condition in the deployment order of the petitioners, clearly states that the seniority of the deployed Teachers are kept in the same Union from where they were deployed. They will be given priority in the forthcoming academic years once eligible vacancy or need for the Teachers arise in the said Union. Only station juniors in the School, where surplus posts occur are taken for common pool of the Union by way of calculating their date of joining in the present School. The entire surplus teachers in the common pool in the Union are listed in accordance with the date of joining in the Union. From the said list, the junior-most teacher in surplus School is deployed in the place of need and in the vacant posts by conducting counseling.

(iv) The deployed teacher is supposed to take Classes for LKG and UKG, as he/she belongs to Elementary Educational Subordinate Service Rules alone. In order to mitigate the problem of deployment of surplus teachers, the Government have started LKG and UKG and the Students strength have increased and surplus teachers are deployed in that Classes.

(v) There is no change in implementing G.O.(1D)No.217, School Education Department, dated 20.06.2019, in maintaining the Union as a separate Unit and seniority of teachers are never going to be affected. Only the surplus teachers in the School are brought to the common pool and they are alone considered for deployment counseling. In previous years, juniors of the Union even though not surplus in the respective Schools, their services to improve the Students strength need be deployed to other Union. This process directly affected the junior teachers regardless of the School where Students strength decreased in the Union. The senior teachers of the Union were given top most priority keeping hope on them that they can improve the Students strength in the School, but juniors are heavily affected.

Only surplus teachers are taken for deployment counseling and non-surplus junior teachers are saved from becoming victims in every deployment counseling. (vi) The staff fixation is arrived at after giving opportunity for the teachers to improve the Students strength upto the first August. Only after calculating the Students strength as on first August, fixation of Staff strength starts. Waiting for another academic year for deployment counseling, would cause hardship, as vacancy cannot be filled up and Students would suffer for want of teachers. The Government has to pay enormous pay to surplus teachers by way of salary. Clause 4(I)(i) of G.O.(1D)No.217, School Education Department, dated 20.06.2019, is not against the Rules, as Union alone is kept as Unit for seniority.

18.I have heard the learned counsel appearing for the parties and perused the materials on record.

19.From the materials on record and the submissions made by the learned counsel appearing for the petitioners and the learned Special Government Pleader, it is clear that every academic year, the students' strength in the Government School and Panchayat Union Schools is decreasing. In view of such decrease, the Staff strength for each academic year is changed. It is admitted by all the parties concerned, in some Schools, there are surplus teachers and in some Schools, there are vacancies. In view of the same, the surplus teachers ought to be deployed to the needy Schools. According to the learned Special Government Pleader, every year the Students strength is ascertained in the end of July and based on the Students strength, staff strength is fixed.

The Government ascertains the Students strength only in July, so that, the parents are given opportunity to admit their children in their School. After ascertaining the Students strength and fixing the staff strength, deployment is made in August. The action of the Department waiting till the end of July of every year to ascertain the Students strength is not invalid. In view of the same, the contention of the learned counsel appearing for the petitioners that deployment would arise at the completion of the academic year and generally, the teachers are deployed in the month of May and policy of the first respondent is not to disturb the teachers in the middle of the academic year having regard to the welfare of the Students at large are without merits. The present deployment is only surplus teachers to the needy Schools.

Only after ascertaining the Students strength, number of surplus teachers can be identified. The Government cannot anticipate the Students strength for the subsequent year at the end of previous academic year and therefore, deployment of surplus teachers in the month of August is valid. 20.The contention of the learned counsel appearing for the petitioners that if senior-most teachers are deployed, his/her promotional avenue would be affected when their turn comes, is without merits. When a teacher is deployed in the same Panchayat Union, there is no dispute with regard to maintaining the seniority in the same Union. When the teacher is deployed in other Union, the Department has assured them that their seniority will be maintained in the same Panchayat Union from where they were deployed to another Union.

The Department has also assured that such a teacher would be given preference when vacancy arises in the Schools in the Panchayat Union from where they were deployed to be posted in the said vacancy.

21.As far as the contention of the learned counsel appearing for the petitioners that by deploying the senior-most teachers, the Department is violating Rule 9 of the Rules, is without merits. Even when the seniors are deployed, their seniority is maintained in the same Union and therefore, there is no violation of Rule 9 of the 73/82

Rules. The petitioners are contending that only juniors can be deployed and senior-most teachers must be retained for the welfare of the Students. The senior-most teachers do not have any vested right for being retained and only juniors must be deployed. There is no reason to retain a surplus senior-most teacher and to deploy the teacher when the said teacher is not surplus in his/her School. As the present Government Order, the Department is identifying the surplus teachers and preparing the list of surplus teachers as per their seniority. They start deployment from the bottom of the said list of surplus teachers, so that, junior-most surplus teachers are deployed to the needy Schools. When all the needy vacant posts in the Union are deployed, if there are still surplus teachers, they are deployed to the other Unions.

There is no infirmity in the Department in following such procedure. There is no need to deploy a teacher when he/she is not a surplus in the School where he/she is employed. Earlier, as per G.O.(1D)No.270, School Education Department, dated 10.07.2012, the Department identified the number surplus posts, whereas, as per the present Government Order, the Department is identifying the surplus teachers and deploying them in the needy Schools. As per G.O.(1D)No.217, School Education Department, dated 20.06.2019, the Department is identifying surplus teachers from the Schools where the said teacher is surplus and the list is prepared. The Department maintains the seniority list for the entire Union and promotions are made as per the said seniority list even if a teacher was deployed in another Union. 22.

The contention of the learned counsel appearing for the petitioners that based on the Union seniority list only, deployment must be made and identification of surplus teachers based on the station seniority, i.e., seniority in the School where the teacher is surplus, is illegal and violative of Rule 9 of the Rules, is not correct.

23.The deployment relates only with regard to surplus teachers to the needy place maintaining the seniority of such a teacher in the same Union where he/she was working/appointed. Therefore, identification of surplus teachers based on the station seniority/school seniority is valid and legal and there is no infirmity warranting interference to set aside G.O.(1D)No.217, School Education Department, dated 20.06.2019 and order of deployment as per the said Government Order.

24.In view of apprehension of teachers as projected by the learned counsel appearing for the petitioners, the following guidelines are formulated.

(i) When a teacher is deployed as surplus from one Union to a needy place in another Union, his/her seniority in parent Union must be maintained unless the teacher opts for being absorbed in the transferred Union.

(ii) When a vacancy or need arises in the parent Union, the teachers deployed from the said Union must be given priority and must be re-deployed to their parent Union. (iii) When the promotional avenue arises in the parent Union, a seniority list must be prepared and all the teachers deployed to the other Union must be given an opportunity to put forth their objections if any, to such seniority list. (iv) After finalising the seniority list of the Union, a Panel for promotion is to be prepared, which must include the names of the teachers, who were deployed to other Union, if they are eligible and they must be promoted and posted in the parent Union as much as possible depending upon the vacancy in the parent Union.

(v) The criteria of three years of service in a particular station to participate in the General Counseling for Transfer insofar as teachers deployed shall include the service rendered by them in a School prior to deployment and both the period of service in the School before deployment and the period of service after deployment, must be taken into consideration in the General Counseling for Transfer. 25.With the above directions, these Writ Petitions are dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
