PRAYER: Petition filed under Article 227 of the Constitution of India to set aside the fair and decreetal order passed by the learned Principal District Judge, Karur, made in C.M.A. No. 6 of 2019 dated 18.07.2022 imposing the cost while reversing the fair and decreetal order in I.A. No. 543 of 2017 in O.S. No. 75 of 2011 dated 16.04.2019 passed by the learned Principal Subordinate Judge, Karur, by allowing this Revision Petition.

ORDER

This Civil Revision Petition invoking Article 227 of the Constitution of India, 1950, has been filed challenging the order passed by the learned 1/4

Principal District Judge, Karur, made in C.M.A. No. 6 of 2019 dated 18.07.2022 imposing the cost while reversing the fair and decreetal order in I.A. No. 543 of 2017 in O.S. No. 75 of 2011 dated 16.04.2019 passed by the learned Principal Subordinate Judge, Karur, by allowing this Revision Petition (hereinafter referred to as the 'Trial Court' for short). 2.The parties are hereinafter referred to as per their description in the suit in O.S. No. 75 of 2011 before the Trial Court for the sake of clarity and convenience.

3.Heard Mr. V.Balaji, Learned Counsel for the Sixth Defendant, Mr. Raguvaran Gopalan, Learned Counsel for the Plaintiffs and perused the materials placed on record, apart from the pleadings of the parties. 4.The Sixth Defendant in the suit in O.S. No. 75 of 2011 has filed this Civil Revision Petition challenging the imposition of cost of Rs.15,000/-. The said amount has been deposited in the Trial Court until the suit has been taken on record.

5.In view of the same, the said amount shall continue to be remain deposited before the Trial Court till the suit is disposed and depending upon the outcome of the suit, the Trial Court shall pass necessary orders releasing the same to the person entitled for the said amount. 6.In the result, the Civil Revision Petition is disposed on the aforesaid terms.
