ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarfied Mandamus, to quash the impugned refusal check slip dated 01.07.2025 and consequently, to direct the second respondent to register the sale deed presented before him on 01.07.2025.
2. Through the impugned order, the second respondent refused to register the sale deed on the ground that a suit decree already exists in respect of Survey Nos. 228/5 and 228/23. The petitioner has purchased only a portion of Survey No. 228/23, specifically Plot No. 51 measuring five cents. In the said survey number, larger extent of 5 acres is available and that the petitioner's vendor had already purchased the said plot as early as the year 1998, which is prior to the filing of the said suit. Therefore, the respondents cannot refuse to register the sale deed by citing a suit decree which is subsequent to the petitioner's purchase.
3. It is a settled proposition of law that the registering authority has no power to adjudicate disputes relating to title. Therefore, the impugned order is quashed. The respondents are directed to register the petition mentioned document, within a period of four (4) weeks from the date of receipt of a copy of this order.

4. With the above directions, this Writ Petition is allowed. There shall be no order as to costs.
