Respondent/Respondent/ Complainant PRAYER :- Petition filed under Section 439(1)(B) of Cr.P.C. to modify the condition imposed on the petitioners by the learned Principal Sessions Judge, Sivagangai in Crl M.P.No.3154/2023 dated 19.07.2023 in so far as depositing a sum of Rs.25,000/- each as non-refundable to the Mediation and Conciliation Centre, Sivagangai. 1/4

ORDER

This Criminal Original Petition has been filed to modify the condition imposed in Crl.M.P.No.3154 of 2023, dated 19.07.2023, on the file of the learned Principal Sessions Judge, Thanjavur, in which, the petitioners were directed to deposit Rs.25,000/- each as non-refundable deposit. 2.The learned counsel for the petitioners would submit that the first accused is the owner and the other accused are agricultural coolies. Hence, prays to modify the condition.

3.It is seen that at the time of hearing the petitioners were also gave an oral undertaking to deposit the said amount. More over, the second and fourth accused are having previous cases, that too, similar in nature. On these grounds only the lower Court has imposed such a condition. I find no reason to interfere with the condition imposed by the Court below.

4.Accordingly, this Criminal Original Petition stands dismissed. However, to comply the said condition, the petitioners is granted for a period of fifteen days, from the date of receipt of a copy of this order.
