O R D E R

With consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse orders is going to be passed in this writ petition, notice to the respondents 5 to 9 is dispensed with.

2. Heard both sides and perused the materials available on record.

3. This writ petition has been filed for issuance of a direction to the 2nd respondent to consider the petitioner's representation dated 18.07.2024 seeking disposal of the petitioner's appeal dated 20.06.2024.

It is the contention of the petitioner that as per the Will executed by the paternal grandfather of the petitioner, he is entitled to the property in Survey No.95/2 and 96/2 and his cousin brother one Chandramohan is entitled to the property in Survey No.95/1 and 96/1. In the year 2018, a portion of properties in Survey No.95/1, 95/2 and 96/2 were acquired for extension of Railway line. However, the said Chandarmohan has obtained patta in his name from the third respondent 2/5

to avail the compensation from the Railway authorities, which is pending in the Court deposit. Challenging the said Patta proceedings, the petitioner has already filed an appeal before the second respondent on 20.06.2024. Since no steps were taken, the petitioner also submitted a representation dated 18.07.2024 to the second respondent seeking expeditious disposal of the said appeal. Now the said Chandramohan is attempting to receive the compensation based on the strength of Patta issued in his name. Hence, he seeks a direction from this Court to dispose the appeal as expeditiously as possible.

Considering the limited relief sought for by the petitioner in this writ petition, this Court directs the second respondent to dispose of the appeal filed by the petitioner dated 20.06.2024 within a period of two months from the date of receipt of a copy of this order, after giving proper opportunity to the petitioner as well as the said Chandramohan, in whose name the Patta has been issued.

6.With the above direction, this writ petition is disposed of. No Costs.
