Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.DEVARAJ.R, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate (crl.side) on behalf of the Respondent, the court made the following order:- In Crl.O.P(MD).No.9332 of 2023 dated 02.06.2023, this Court directed the petitioner to appear before the learned Judicial Magistrate, Fast Track Court, 1/3

Nagercoil, on the next hearing date and file a petition under Section 70(2) of Cr.P.C to recall NBW issued against him.

2. This petition has been filed mainly on the ground that due to his health issue, he did not appear before the trail Court on the hearing date.

3. Considering the conduct of the petitioner, this Court is not inclined to extend time to comply with the order passed in Crl.O.P(MD).No.9332 of 2023 dated 02.06.2023. The petitioner is at liberty to workout his remedy before the appropriate forum.
