O R D E R
This writ petition has been filed for a mandamus seeking for a direction to the respondents to consider and dispose of the petitioner's representation dated 03.03.2023 seeking to fix his seniority based on the date of the petitioner's initial appointment i.e., 14.12.2005.
2. The petitioner, who is working as a Cook, claims that his seniority has been erroneously fixed and he seeks his seniority to be fixed from the date of his initial appointment i.e., 14.12.2005. He had given a representation before filing this writ petition seeking to refix the seniority. According to him, the said representation was not considered. Only under those circumstances, he has filed this writ petition.
3. A counter-affidavit has been filed by the third respondent stating that a proper representation was not given by the petitioner to the competent authority. Only due to the same, the respondents stated that they have not considered the 2/5
petitioner's representation. No prejudice would be caused to the respondents if the petitioner is allowed to give a fresh representation seeking to refix his seniority within a time frame to be fixed by this Court and a direction is issued to the respondents to consider the same on merits and in accordance with law and pass final orders within a time frame to be fixed by this Court.
4. This Court is not expressing any opinion on the merits of the petitioner's representation, as it is for the respondents to consider the same on merits and in accordance with law.
5. For the foregoing reasons, this Court directs the petitioner to submit a fresh representation to the third respondent seeking to refix his seniority from the date of the petitioner's initial appointment i.e., 14.12.2005, within a period of one week from the date of receipt of a copy of this order. On receipt of the said representation, the third respondent shall pass final orders on merits and in accordance with law within a period of eight weeks thereafter.
6. With the aforesaid direction, the writ petition stands disposed of. No costs.
