ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/4

for the offence punishable under Sections 296(b), 118(1), 351(3) of BNS, in Crime No.342 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there was a previous enmity between the petitioner and the defacto complainant, as a result of which, on 06.07.2025, the petitioner had attacked the defacto complainant with stone, due to which, he caused injuries. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that the petitioner had attacked the defacto complainant due to which he caused injuries. He further submitted that the injured person is still taking treatment in hospital and the investigation is at initial stage. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also the fact that nature of the offence committed by the petitioner and the investigation is still pending and the victim is still in hospital and the custodial interrogation is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
