The Petitioner herein seeks a direction to the respondents 1 and 2 to survey the property in S.No.19/2B to an extent of 0.41.50 hectares situated at Thullukankurichi Village, Vembakottai Taluk, Virudhunagar District by considering the Petitioner's representation, dated 22.5.2025.
2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.Side) takes notice for the third respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.According to the Petitioner, the subject property originally belong to the Petitioner's grand-mother Ramammal and she executed a settlement deed in favour of the Petitioner by registered document, dated 1.7.2022. Patta for the subject property 2/5
was also issued in the name of Petitioner as per the order passed by the Zonal Deputy Tahsildar, Vembakottai Taluk,Virudhunagar District on 13.7.2024 in Patta No.1777. The Petitioner submitted the instant application on 22.5.2025 in application No. 2025/0123/26/008156 seeking survey of the subject property. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.
4.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit that the application filed by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the respondents 1 and 2 are directed to consider the application filed by the Petitioner, dated 22.05.2025 and pass orders on its own merits after issuing notice to the Petitioner, neighbouring land owners and other interested parties, if any, within a period of 8 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands 3/5
disposed of. No costs.
