ORDER
This petition has been filed seeking to relax the condition imposed on the petitioner in Crl.M.P.(MD)No.8467 of 2026 in Crl.A.(MD)No. 1071 of 2025 by order dated 30.04.2026.
2. The learned Government Advocate (Crl. Side) submits that the petitioner, while regularly complying with the condition No.6(iii), by reporting before the C2 Race Course Police Station, Coimbatore, daily at 10.30 a.m., has not complied with the condition No.6(ii), as he has not filed an affidavit of undertaking along with the sureties before the respondent Police stating that he will not indulge in any further offence, will not visit the occurrence village and will not disturb the victim.

The learned counsel appearing for the petitioner submits that the petitioner is a resident of Tirunelveli and he is regularly complying with the condition No.6(iii) and appearing before the C2 Race Course Police Station, Coimbatore and therefore, he is not in a position to give an undertaking affidavit before the respondent Police. Further, the 2/5
petitioner has to travel a long distance for filing the undertaking affidavit before the respondent Police.
4. This Court is not inclined to accept the reasons stated by the learned counsel for the petitioner for relaxing the condition. However, the petitioner shall forward his undertaking affidavit to the respondent Police and the sureties shall appear before the respondent and file their undertaking affidavit that the petitioner will not indulge in any further offence, will not visit the occurrence village and will not disturb the victim.
