Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent 3 to consider the petitioner's representation dated 01.10.2021 and to give No Objection Certificate to the petitioner for issuing Batch for the purpose of running an auto as rental purpose. O R D E R

This Writ Petition has been filed to direct the respondent 3 to consider the petitioner's representation dated 01.10.2021 to issue No Objection Certificate for getting batch endorsement of his license.

2.The case of the petitioner is that, the petitioner was arrayed as accused in Crime No.169 of 2019, for the offences punishable under Sections 143, 283 & 341 IPC and that FIR came to be quashed as per order of this Court in Crl.O.P(MD) No.15998 of 2020, on 05.01.2020. Now, he applied for getting endorsement in his licence for driving Auto. When he approached the second respondent to get No Objection Certificate, they have stated that the case in Crime No.169 of 2019 is pending against the petitioner. But, whereas, the said First Information Report was quashed as per order https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.18968 of 2021 of this Court in Crl.O.P(MD) No.15998 of 2020, on 05.01.2020. Hence, this petition.

3.Considering the limited prayer sought for by the petitioner and taking into consideration the fact that the First Information Report in Crime No.169 of 2019 has already been quashed by the order of this Court, there shall be a direction to the second respondent to issue No Objection Certificate to the petitioner for obtaining batch endorsement, within a period of 15 days from the date of receipt of a copy of this order.

4.With the above direction, this Writ Petition is disposed of. No costs.
