This Criminal Original Petition has been filed to quash the charge sheet dated 28.07.2014, made in C.C.No.276 of 2014, on the file of the learned Judicial Magistrate, Tiruchendur, Tuticorin District.
2.Today, when the matter was taken up for hearing, the learned Government Advocate (Crl. side) appearing for the first respondent, on instructions, submitted that already the trial has been commenced and eight witnesses have been examined by the learned Judicial Magistrate. He further submitted that the matter is posted for examination of the Investigating Officer https://hcservices.ecourts.gov.in/hcservices/
3.At this juncture, the learned counsel for the petitioners seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.
4.In view of the endorsement so made by the learned counsel appearing for the petitioners, the Criminal Original Petition stands dismissed as withdrawn.
5.However, taking into consideration the facts and circumstances of the case and also considering the fact that the case is pending from the year 2014, the learned Judicial Magistrate, Tiruchendur, Tuticorin District, is directed to proceed with the trial and dispose of the case within a period of one month from the date of receipt of a copy of this order. Consequently, the connected miscellaneous petitions are closed.
