ORDER : The Court made the following order :- Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) for the respondent. 2.The petitioner is arrayed as accused No.1. He was arrested and remanded to Judicial Custody on 10.08.2019, for the offences punishable under Sections 294(b), 341, 324, 506(ii) and 307 of IPC, in Crime No.121 of 2019, on the file of the respondent police. He seeks bail.

3.When the matter was taken up hearing, the learned Government Advocate (Crl. side) submitted that the petitioner has also parallelly moved Cr.M.P.No.2913 of 2019 before the Sessions Court and it is listed for next hearing on 16.09.2019. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.12626 of 2019 4.The petitioner's counsel states that he is not aware about the filing of the same. Therefore, he seeks leave to withdraw this petition with liberty to pursue the petition filed before the Court below. It is made clear that dismissal of this bail petition as withdrawn will not preclude the Court below from disposing the bail petition filed by the petitioner herein on merits. 5.With this liberty and observations, the Criminal Original Petition stands dismissed as withdrawn.
