Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 3rd respondent in "Nil" dated 19.04.2021 and quash the same as illegal and unconstitutional and consequently, direct the respondents to provide electricity service connection to the petitioner's house situated at Plot No.66 situated at SMS Nagar, Nelmudikarai, Thiruppuvanam Town and Taluk, Sivagangai District, by considering his application dated 18.04.2021.

ORDER

The petitioner has approached TANGEDCO and submitted an application dated 18.04.2021 for grant of service connection. However, the 3rd respondent, by his proceedings dated 19.04.2021, rejected the application on the ground that the petitioner has constructed the house without a building plan approval. 2/6

2. The learned counsel for the petitioner submits that the lay-out approval given to the petitioner is very much available.

3. The learned Special Government Pleader appearing for the 4th respondent submits that the petitioner has not submitted any application for building plan approval.

4. Considering the said submission, the petitioner is directed to submit an application before the 4th respondent for building plan approval by paying necessary fees, within a period of one week from the date of receipt of a copy of this order. On receiving of the said application, the 4th respondent shall consider the same and pass orders within a period of four weeks from the date of receipt of the application. After receipt of the building plan approval, the petitioner shall approach the TANGEDCO and submit an application for electricity service connection. On receipt of the said application, the 3/6

TANGEDCO shall consider the case of the petitioner positively within a period of one week from the date of receipt of the said application.

5. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 27.07.2023 ogy NCC : Yes / No.
