PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the Special Sessions Court, Ramanathapuram (Special Court for Trial of Scheduled Caste and Scheduled Tribe Act Cases) to consider the bail application of the petitioners on the same day of surrender in Crime No.20 of 2023 on the file of the second respondent Police Station.

For Petitioner : Mr.A.Subramanian For R1 & R2 : Mr.B.Thanga Aravindh Government Advocate (Crl.side) O RDER This petition is filed seeking for a direction to the Special Sessions Court, Ramanathapuram (Special Court for Trial of Scheduled Caste and Scheduled Tribe Act Cases) to consider the bail application of the petitioner on the same day of his surrender in Crime No.20 of 2023 on the file of the respondent No.2 Police. 2.When the matter was taken up for hearing, the learned Government Advocate (Crl.side) has submitted that the petitioner has committed the offence under Sections 341, 147, 148, 294(b), 324, 435 and 506(ii) IPC, 3(1)(r) and 3(1) (s) of the SC/ST (Prevention of Atrocities) Amendment Act, 2015 and 25(1A) of the Arms Act. It is also submitted that there are 6 more earlier cases pending against the petitioner.

3.Considering the magnitude of the allegations levelled against the petitioner and also the fact that the petitioner is involved in various enactments 2/4

including the Arms Act, since the offence is not exclusively under the SC/ST (Prevention of Atrocities) Amendment Act, 2015, the relief sought for by the petitioner cannot be considered. This Petition is dismissed, accordingly.
