PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to delete the petitioners husband Murugesan name in the ration card and issue a fresh ration card with the petitioner's name and her daughter's name by considering the 1/5

O R D E R

The petitioner, a divorcee has applied for a fresh ration card on 11.07.2023, based on a decree of divorce passed by the Family Court, Tuticorin in HMOP No.260 of 2022 and has filed this writ petition that his application has not been considered by the respondents.

2. The learned counsel appearing for the petitioner submits that since the petitioner is a single mother, she is entitled to get the benefit under the Mahalir Urimai Thogai Thittam 2023. However, in the absence of ration card, the respondents could not proceed with the petitioner's claim under the above scheme. Therefore, the petitioner has filed an interim direction to the respondents to consider her case, in the light of the decree passed by 2/5

the Family Court, Tuticorin in HMOP No.260 of 2022, dated 23.05.2023.

3.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader, who takes notice for the respondents submits that the petitioner's application dated 11.07.2023 has now been forwarded by the Tahsildar to the District Collector for passing necessary orders. The petitioner, in fact, has applied for a Ration Card in order to avail the benefit of Mahalir Urimai Thogai Thittam 2023.

4.Considering the submissions made on either side, this writ petition is disposed of with a direction to the third respondent/the Special Tahsildar, Civil Supplies and Consumer Protection Department, Tuticorin to issue a fresh Ration Card to the petitioner, in the light of the decree passed by the Family Court, Tuticorin in HMOP No.260 of 2022, dated 23.05.2023 within a period of eight weeks from the date of receipt of a copy of this order. 3/5

The second respondent/ the Tahsildar, Tuticorin shall also consider the case of the petitioner for Mahalir Urimai Thogai Thittam 2023. No costs.
