Criminal Original Petition filed under Section 528 of BNSS to direct the Learned Principal District and Sessions Judge (PCR), Theni to consider the bail application to be filed by the petitioner on the same day of his surrender in Cr.No.78 of 2025 on the file of the 2nd respondent police
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Vikram,Advocate for the Petitioner and of Mr.A.S.Abul Kalam Azad,Government Advocate(Crl.Side) for the Respondents 1 & 2, this court made the following order:
This Criminal Miscellaneous Petition is filed seeking extension of time granted in Crl.OP(MD) No.7369 of 2025, dated 23.04.2025 and extended subsequently, on the application filed by the petitioner in Crl.MP(MD) No.6970 of 2025 in Crl.OP(MD) No.7369 of 2025, dated 10.06.2025, to surrender before the jurisdictional Court.
2.While ordering Crl.OP(MD) No. 7369 of 2025, this Court directed the petitioner to surrender before the concerned jurisdictional Court, within a period of fifteen days from the date of receipt of a copy of that order. Thereafter, the petitioner has moved an application in Crl.MP(MD) No.6970 of 2025, sought for extension of time as there was some delay in getting the order copy, due to his health issues. This Court, by its order, dated 10.06.2025 has extended the time by granting further period of 10 days from the date of receipt of a copy of that order. Without exhausting the order, dated 10.06.2025, the petitioner has now moved this application, seeking further extension of time.
3.Considering the conduct of this petitioner in not complying with the order, even after the time was extended by this Court on 10.06.2025, this Court is not inclined to grant further time to surrender before the jurisdictional Court. 4.Accordingly, this Criminal Miscellaneous Petition is dismissed.
