This writ petition has been filed by the petitioner seeking a direction to the first respondent to make payment of the provident funds amount for the year 2012-13 to the workers, within a time stipulated by this Court.
2. This matter came up for consideration yesterday i.e. 26.02.2025. However, there was no representation for the petitioner and hence, the same was directed to be listed today under the caption "for dismissal".
3. Accordingly, this matter is listed today under the caption "for dismissal". However, there is no representation for the petitioner once again.
4. Learned counsel appearing for the first respondent submitted that the respondent - Employees Provident Fund Organisation has already received the entire amount due from the employer and is ready to disburse the amount as sought by the petitioner in the prayer, provided necessary particulars are furnished in Form-III by the employer of the workers in question. The employer, under whom the members of the petitioner - Union are working, is not made as a party to the present writ petition.
5. In view of the same, this writ petition is disposed of permitting the petitioner - Union to ensure that all the required particulars, as may be required by the first respondent, are furnished to the first respondent and on
furnishing all such particulars, the first respondent shall disburse the amounts to the respective workers in accordance with law, within a period of six weeks from the date of receipt of such particulars from the petitioner - Union.
6. Accordingly, this writ petition is disposed of. No costs. 27.02.2025 NCC :
