PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to impugned refusal slip dated 03.03.2025 issued by the 1st respondent vide RFL/Paramakudi/21/2025 and to quash the same as illegal and consequently, to direct the respondent herein to register the sale deed dated 26.02.2025 presented by the petitioner in respect of the property comprised in Sur.No. 142/1A and 143/1A admeasures to an extent of 487 3/4 (321 3/4 and 166) sq.ft. situated at Malaiyankudiyiruppu, Old Ward No. 7, New Ward No. 8, Present Ward No.10, Emaneshwaram, Paramakudi Municipal, Paramakudi Sub Division, Sivagangai Registration District, Ramanathapuram District within a stipulated time period in accordance with law.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal slip dated 03.03.2025 issued by the 1st respondent vide RFL/Paramakudi/21/2025 and consequently, to direct the respondent herein to register the sale deed dated 26.02.2025 presented by the petitioner within a stipulated time period in accordance to law. 2.Through the impugned order, the respondent has stated that the petitioner is tracing his title through unregistered sale. Therefore, the subsequent document is non-est in the eye of law.

3.However, the learned Counsel appearing for the petitioner submitted that he has certain other documents to prove his title and the present impugned order was passed without hearing him. Therefore, there is violation of principles of natural justice.

4.Therefore, the impugned order is quashed, consequently, the respondent is directed to issue notice to the petitioner, grant him personal hearing and the petitioner is at liberty to produce all the documents. Thereafter, the respondent shall pass orders in accordance to law within a period of four weeks from the date of receipt of a copy of this order. 2/4

5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
