ORDER
This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.
2. The petitioner has applied for a fresh passport on 03.04.2025 vide application TR1077531649125.
3. It appears that the petitioner is an accused person (A31) in an FIR registered by the second respondent police in Crime No.166 of 2025 dated 17.03.2025 for the offences under Section 189(2) and 126(2) of the Bharatiya Nyaya Sanhita, 2023.

4. The learned Government Advocate (Crl.Side) for the second respondent confirms that although investigation has been completed, the charge sheet has not been filed.
5. It is noticed that the petitioner was involved in a protest on 17.03.2025 and is otherwise. not involved in any serious offence. Considering the fact that no charge sheet has been filed till date, although the investigation has been completed, there shall be a direction to the first respondent to process the aforesaid passport application of the petitioner and issue the same to the petitioner within a period of two (2) months from the date of receipt of a copy of this order, in case the petitioner satisfies the other criteria, that are required under the Indian Passport Act, 1967 and Rules made thereunder.
6. It is made clear that the petitioner shall cooperate with the second respondent, in case the charge sheet is filed pursuant to the FIR registered in Crime No.166 of 2025, dated 17.03.2025.

7. In case the petitioner fails to cooperate with the Law Enforcing Authority, the first respondent is at liberty to cancel the passport that is to be issued to the petitioner.
