Respondent/Complainant PRAYER: Criminal Revision Case is filed under Section 397 read with Section 401 of the Code of Criminal Procedure, to call for the records of the impugned judgment dated 12.03.2014 passed by the I Additional District Sessions Judge, Thoothukudi in Criminal Appeal No.110 of 2013 confirming the conviction and sentence passed by the learned Judicial Magistrate, Tiruchendur in S.T.C.No.918 of 2009 and set aide the same.

ORDER

This criminal revision case has been filed as against the conviction and sentence imposed by the Courts below under Section 138 of Negotiable Instruments Act.

2.Though notice was ordered in the earlier occassion to the respondent/complainant, the respondent has not entered appearance so far.

3.Today (ie., 19.09.2019), when the matter is taken up for hearing, the learned counsel appearing for the petitioners submits that the first petitioner died and he is not pressing the criminal revision case in respect of the second petitioner. Crl.R.C(MD)No.330 of 2014 in a position to get a copy of the death certificate of the first petitioner from the legal heirs. According to him, the legal heirs of the first petitioner are not interested in pursuing the revision case.

4.In view of the above submission and the endorsement made by the learned counsel appearing for the petitioners, this criminal revision case is dismissed as abated in respect of the first petitioner and in respect of the second petitioner, this criminal revision case is dismissed as not pressed.
