RESPONDENT/COMPLAINANT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Modify the condition to the petitioners shall stay at Trichy and report before the Contonment Police Station daily at 10.30 A.M. for a periiod of one month and thereafter report before the Respondent Police daily at 10.30 A.M. until further orders in CRL OP(MD) No.11614 of 2023 dated 28.06.2023.
Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. MURUGAN.R, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate(Crl.side) on behalf of the Respondent, the Court made the following order:- This petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.(MD)No.11614 of 2023 on 28.06.2023.
2. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition regularly and he prayed for relaxation of the said condition.
3.The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition regularly and investigation is still pending. There is no previous case against him.
4.Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.O.P.(MD)No.11614 of 2023 on 28.06.2023 is relaxed and the petitioner shall report before the respondent police as and when required for interrogation.
