PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of certiorari to call for the entire records in connection with the impugned order of the 2nd respondent in Tha.A.Po.Ka/ Kumba / Kama / L1 / Sirappu / 2022 dated 03.06.2022 and the consequential order in Tha.A.Po.Ka / Kumba / Kama / L1 / Sirappu / 2022 dated 03.08.2022 quash the same as illegal and consequently directing the respondents to take necessary action in order to records the enquiry proceedings against the petitioner under the CCTV within a time stipulated by this Court.

ORDER

The petitioner a Driver of the respondent Transport Corporation has been issued with a charge memo dated 19.01.2022 for his unathorised absence from duty from 05.01.2022 to 16.01.2022. The respondent Corporation has also ordered for an enquiry by appointing an enquiry officer. The petitioner with a grievance as against the enquiry officer has made a representation and sought for CCTV footages of the enquiry proceedings, but it was rejected by the impugned order dated 03.06.2022.

2.When this writ petition has been taken up for hearing, the learned Counsel for the respondents submits that enquiry was completed and order of punishment was passed. The petitioner has also challenged the same before this Court in WP(MD)No.23089 of 2022 and it was disposed of by this Court by order dated 15.03.2024. According to the learned Counsel for the respondent Corporation, as against this order 2/4

dated 15.03.2024 passed in WP(MD)No.23089 of 2022, they have filed a review application and it is pending.

3.Considering the subsequent developments this writ petition is closed. No costs.
