ORDER : The Court made the following order :- The petitioner, who is an accused in C.C.No.62 of 2024 on the file of the Principal Special Court for Trial of Narcotic Drugs and Psychotropic Substances Act Cases, Madurai, has filed this application seeking bail. The said case was registered 1/3

for the offence under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.584 of 2023 on the file of the respondent police.

2.The case of the prosecution is that the petitioner along with other accused persons was in illegal possession of 228 kgs of ganja. Hence the case. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. However he has been languishing in the jail and this is the fifth bail petition. 4.The learned Government Advocate (Crl Side) appearing for the State submits that this is the fifth application filed by the petitioner for bail. The earlier applications were dismissed by this Court on 03.11.2024, 03.01.2024, 26.03.2024 and on 11.06.2024 in Crl.O.P.(MD) Nos.18327 and 21785 of 2023 and 4713 and 8506 of 2024 on the ground that the petitioner has not satisfied the twin conditions as required under Section 37 of the NDPS Act.

5.This Court considered the rival submissions made. Since there is no change in 2/3

circumstances from the dismissal of the earlier bail petition, this criminal original petition is dismissed.
