PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 4 herein to conduct detailed enquiry into the misappropriation of the funds of the R-357 Cooperative Credit Society situated at Mudiganam Village, Aravakurichi Taluk, Karur District, by the fifth respondent on the basis of petitioner's representation dated 24.05.2023 and file a report within a time stipulated by this Court.

O R D E R
[Order of the Court was made by S.S.SUNDAR, J.] Making several serious allegations against the fifth respondent, by name, R.Subramanian, who was the Secretary of a Cooperative Society, by name, R357 Mudiganam Cooperative Credit Society, the petitioner has filed filed this writ petition for issuance of a writ of mandamus directing the official respondents to conduct a detailed enquiry into the matter, based on his representation dated 24.05.2023 and file a report.
2. Learned Government Pleader appearing for the respondents 1 & 2, on instructions, states that the petitioner submitted a representation earlier, however, he did not cooperate for any enquiry and produce any document in support of his allegations against the fifth respondent.
3. Learned Government Advocate (Criminal Side) appearing for the respondents 3 & 4, on instructions, states that enquiry with regard to the allegations made by the petitioner against the fifth respondent is already commenced and it is now pending.
4. To be noted, the petitioner, who does not cooperate for the enquiry and produce any material in support of his contentions, cannot maintain this writ petition. However, recording the above submissions, this writ petition is closed with an observation that depending upon the outcome of the enquiry, appropriate proceedings may be initiated by the respondents 3 & 4 in accordance with law. No costs.
