PRAYER: Petition is filed under Section 11 of Contempt of Courts Act, 1971, r/w Section 151 of CPC, to revive the Contempt Petition (MD)No. 1360 of 2020 closed vide order dated 25.02.2021, on the file this Court. ORDER

This petition has been filed to reopen the Contempt Petition (MD)No.1360 of 2020 which was closed vide order dated 25.02.2021 by the co-ordinate bench of this Court.

2. Heard Mr.P.M.Vishnuvarthanan, learned counsel, appearing for the Petitioner and Mr.D.Sadiq Raja, learned Additional Government Pleader accepts notice on behalf of the Respondent. Therefore, no further notice is required to be issued to the Respondent.

Today, when the matter is being taken up, Mr.D.Sadiq Raja, learned Additional Government Pleader for the Respondent, filed an affidavit of compliance along with the order dated 09.08.2025, passed by the District Educational Officer (Elementary), Nagercoil and submits that the Respondent had complied with the judgment and order of the Writ Court in W.P.(MD) No.25422 of 2018, dated 21.03.2019. This fact is stated in paragraph nos. 6 and 7 of the compliance affidavit, which mentions that necessary proposal have been forwarded by the School on 2/6

10.09.2024 and the same was duly processed and now necessary steps have been taken for disbursing the monetary benefits to the Petitioner. A copy of the said order along with the compliance affidavit has been taken on record and the same has been furnished to the learned counsel for the Petitioner. He also assures this Court that the monetary benefits will be paid, after completing other formalities, within a period of three weeks from today, without fail. Therefore, he prays that the Respondent may be discharged from the contempt proceedings and the contempt petition may be disposed of accordingly.

Mr.P.M.Vishnuvarthanan, learned counsel for the Petitioner received the copy of the order dated 09.08.2025 along with the compliance affidavit and submits that the direction issued by the Writ Court vide judgment and order dated 21.03.2019 passed in W.P.(MD)No.25422 of 2018 has been complied with. The learned counsel requests that, as assured by the Additional Government Pleader, the monetary benefits be paid within three weeks. Accordingly, he has no objection to the Respondent being discharged from the contempt proceedings at this stage. 3/6

Considering the submissions made by the learned counsel for the Petitioner and the learned Additional Government Pleader for the Respondent, and upon perusal of the order dated 09.08.2025, passed by the District Educational Officer (Elementary), Nagercoil, this Court is satisfied that the Respondent has complied with the judgment and order of the Writ Court 21.03.2019 passed in W.P.(MD)No.25422 of 2018. The learned Additional Government Pleader has also assured that the monetary benefits will be disbursed to the Petitioner within a period of three weeks from today. In view of the assurance given by the learned Additional Government Pleader, this Court deems it appropriate to dispose the present petition, as no useful purpose would be served by keeping them pending. Accordingly, the Respondent is discharged from the contempt proceedings at this stage.

6. In view of the above, the Sub Application is disposed of with a direction to the Respondents to disburse the monetary benefits to the Petitioner, within a period of three weeks from today, without fail. The file shall be consigned to the record. There shall be no order as to costs. 4/6

7. Let a copy of this order be given to Mr.D.Sadiq Raja, learned Additional Government Pleader for necessary compliance and information to the Respondent.
