PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the Impugned order/communication dated 21.06.2025 passed by the fourth respondents and quash the same, and consequently direct the Respondents to forthwith conduct the survey and demarcate the boundaries of the petitioners land in S.No. 100/22B and S.No.100/23, Thoppoor Village, Madurai District, within a stipulated time frame fixed by this Court.

The writ petition is filed challenging the order uploaded by the fourth respondent in the online portal rejecting the application submitted by the petitioner seeking survey of his property. 2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself. 2/6

3.The petitioner claims right over 2178 square feet of land in survey Nos. 100/2 and 100/3 in Thoppur village, Madurai District. The patta for the subject property stands in the name of the petitioner in patta No.114. He filed an application before the fourth respondent seeking survey of the property on 19.02.2025. The said application was rejected by the fourth respondent by impugned order dated 21.06.2025 uploaded in online portal. The petitioner also received a WhatsApp communication that his application was rejected for his failure to upload patta for the subject property. Aggrieved by the said order, the petitioner has come before this Court.

4.The learned Counsel appearing for the petitioner would submit that along with online application, the petitioner also uploaded patta for the subject property. Without verifying the same, the impugned order has been passed by the fourth respondent. However, the learned Counsel appearing for the petitioner would further submit that the petitioner is ready to submit the patta for the subject property before the fourth respondent within the time stipulated by this Court. 5.The learned Additional Government Pleader, who takes notice 3/6

for respondents, submits that if patta for the subject property is produced, the respondents are ready to survey the property as per the application. 6.In view of the same, the petitioner is directed to submit the patta for the subject property before the fourth respondent within a period of two weeks from the data receipt of a copy of this order. On receipt of patta, the fourth respondent shall consider the application submitted by the petitioner and pass final orders on its own merits within a further period of eight weeks, after affording reasonable opportunity to the petitioner, neighbouring land owners and other interested parties. 7.With the above direction, this writ petition stands disposed of.
