ORDER
The petitioner herein seeks a direction to the respondents to consider his representation dated 16.06.2025 and further to direct the fourth respondent to issue computer patta in the names of petitioner, her mother, Seethai and her brother, Sudhakar and also to rectify the mistake made in the revenue records with regard to the classification of land, during the UDR updation, in respect of the property situated in Survey No.1705/1, with an extent of 0.75.5 Hectare, at Meelavittan Part-2
Village, Thoothukkudi Taluk, Thoothukkudi District. 2.Heard the arguments of Mr.K.Jerish Neeraj, learned counsel appearing for the petitioner and Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the petitioner that the subject property originally belonged to his family and during UDR updation, the classification of the property has been wrongly entered as Government Poramboke. The petitioner herein filed a civil suit against the Government and the fourth respondent herein in O.S.No.4 of 2021, on the file of the II Additional District Court, Thoothukkudi, seeking declaration of title and injunction over the subject property and the said suit was decreed in favour of the petitioner. Based on the civil court decree, the petitioner submitted various representations before the respondents seeking issuance of joint patta in the names of the petitioner and the above mentioned persons. The last of the representation was submitted on 16.06.2025. However,
the same has not been considered. Hence, the petitioner has come before this Court.
4.The learned Government Advocate appearing for the respondents would submit that the representation of the petitioner will be considered by the second respondent in accordance with law. 5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation of the petitioner dated 16.06.2025 and pass final orders on its own merits, within a period of twelve weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and other interested parties. Accordingly, this writ petition is disposed of. No costs.
