O R D E R

This petition has been filed seeking a direction to the second respondent not to harass the petitioner and his family members in the guise of enquiry on the basis of the false complaint, based on the petitioner's representation dated 15.10.2021. 1/3

2.When the matter is taken up for hearing, the learned counsel for the petitioner submitted that he is daily wager and he is no way involved in the crime. However, he was taken custody on suspicion and he was assaulted even in the life line also. 3.The learned Additional Public Prosecutor submitted that a case has been registered stating that 5 soverings of gold jewel has been robbed from the complainant. CCTV footage was also obtained. On seeing the footage resemblance was noticed that this petitioner and on that basis enquiry was made and after making all the enquiry, it is found that he is not involved in the occurrence and later released. Except that no harassment is made against the petitioner. 4.However the learned counsel for the petitioner the third respondent making continuous call to the petitioner and asked him to attend the enquiry, if so required.

5.The learned Additional Public Prosecutor submitted that involvement of the petitioner is ruled out and initial enquiry was completed. Harassing the petitioner and call to the police station frequently may not arise. The petitioner is at liberty to workout his remedy with regard to alleged assault etc., through appropriate proceedings.

6.With the above liberty this criminal original petition is disposed of.
