Respondents PRAYER: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to revise and fix the Selection Grade scale of pay of the petitioners in the cadre of Lab Assistant at Rs.9,300-34,800 with Grade Pay of Rs.4,200/, on par with similarly placed employees who were granted Selection Grade prior to 31.05.2009, by extending the benefit of the Government Letter dated 25.07.2014, taking into consideration the fact that the post of Lab Assistant does not carry any promotional avenue consequent upon the issuance of G.O.Ms.No.63, Finance (Pay Cell) Department, dated 26.02.2011, and consequently direct the respondents to revise the pay, pensionary and all other attendant service benefits of the petitioners and disburse all consequential monetary benefits, including arrears by considering the petitioner's representation dated 06.04.2026 within the time stipulated by this Court. ORDER
The present Writ Petition has been filed seeking a direction to the respondents to revise and fix the Selection Grade scale of pay of the petitioners in the cadre of Lab Assistant at Rs.9,300-34,800 with Grade Pay of Rs.4,200, on par with similarly placed employees who were granted Selection Grade prior to 31.05.2009, by extending the benefit of the Government Letter dated 25.07.2014. The petitioners further seek revision of their pay, pensionary benefits, and all other attendant service benefits, together with disbursement of the consequential monetary benefits, including arrears, by taking into consideration the fact that the post of Lab Assistant has no promotional avenue consequent upon the issuance of G.O.Ms.No.63, Finance (Pay Cell) Department, dated 26.02.2011, and by considering their representation dated 06.04.2026 within a time frame to be stipulated by this Court.
2.The petitioners have submitted a representation to the 3/6
respondents on 06.04.2026 seeking the aforesaid relief. 3.Since the issue involved pertains to a policy decision, a writ of Mandamus cannot be issued as sought for by the petitioners. However, the representation submitted by the petitioners may be considered by the competent authority. Therefore, the first respondent is directed to consider the petitioners' representation dated 06.04.2026 and pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. 4.With the above direction, this Writ Petition stands disposed of. No costs.
