Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 2nd respondent to dispose of petitioner's representation, dated 29.05.2025, on merits, after conducting proper enquiry after providing opportunities to the petitioner.

ORDER

The petitioner herein seeks a direction to second respondent to consider his representation, dated 29.05.2025, and pass final orders on its own merits.

It is the case of the petitioner that 13.72 acres of land in Survey No.1314 in Uchapatti, hamlet of Viralipatti Village, Nilakottai Taluk, Dindigul District, was originally owned by his grandfather - Mandayan @ Subban, with revenue records in his name. Now, the above said survey number is divided into two parts as 1314/1 and 1314/2. New sub-division No.1314/1 is classified as Government land and 1314/2 is registered in the name of one Bose. These changes have been effected during UDR erroneously. Therefore, the petitioner submitted a representation before second respondent on 29.05.2025, seeking cancellation of entry made in UDR updation and restoration of the same in his favour. The same has not been considered. Hence, he has come before this Court.

3. The learned Additional Government Pleader, appearing for the respondents, would submit that the representation of the petitioner will be considered on its own merits, provided the petitioner produces documents, supporting his claim that the entire extent was owned by petitioner's grandfather.

4. In view of the said submission, without expressing any opinion on the merits of the matter, the petitioner is directed to produce documents in support of his claim that his grandfather owned the entire extent of 13.72 acres of land in Survey No.1314 before second respondent within a period of two weeks from the date of receipt of copy of this order. On production of such documents, the representation submitted by the petitioner shall be considered by second respondent and final orders shall be passed on its own merits within a further period of twelve weeks, after affording reasonable opportunity to petitioner, above mentioned Bose, mentioned in the representation, and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 17.07.2025
