the records relating to the order dated 15.03.2023 passed in Cr.MP.No.389 of 2023 in Crime No.4 of 2023 on the file of the special Court for trial of cases under SC/ST ( POA)Act, Theni and set aside the same as arbitrary and consequently to release the petitioner on bail in connection crime No.4 of 2023 on the file of the 2nd respondent police.
ORDER:- This Criminal Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon perusing the order of this court dated 28.04.2023 and upon hearing the arguments of Ms. Pragalathan, Advocate for the Petitioner and of Ms. Vaikam Karunanithi, Government Advocate for the respondent(s), this Court made the following order: "This Miscellaneous Petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.(MD).No.7052 of 2023 in Crl.A.(MD).No.224 of 2023 on 28.04.2023.
2. The learned counsel for the petitioner would submit that the petitioner is complying with the Conditions imposed by this Court regularly and hence he prayed to relax the condition.
3.The learned Government Advocate (Criminal Side) would submit that petitioner is complying with the conditions imposed by this Court regularly. Further, a charge sheet was filed before the learned Sessions Judge, Special Court for Trial of Cases under SC/ST (POA) Act, Theni and the same was taken on file in Spl.S.C.No.15 of 2023.
