This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to grant permission and adequate police protection to conduct "Vinayagar Idol Procession" programme on 31.08.2022 at 05.00 pm to 06.00 pm in the eve of Vinayagar Chathurthi festival at Peraiyur, Peraiyur Taluk, Madurai District.
2. The learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. When the matter is taken up for hearing today, the learned Additional Advocate General appearing for the State would submit that the respondent Police has submitted a report, wherein it has been stated that since there is a possibility of community clash and law and order problem, the Police is having serious objections to grant permission. 2/5
4. As rightly contended by the learned counsel for the petitioner, the petitioner has appeared for the meeting held at Peraiyur Police Station on 23.08.2022 and agreed to conduct the festival as directed.
5. Admittedly, the requisition of the petitioner is pending before the respondent. Hence, the second respondent is directed to consider the petitioner's representation as per the guidelines given in the Government Order in G.O.(Ms)No.598, Public (Law & Order-B) Department, dated 09.08.2018.
6. In view of the above, the second respondent is hereby directed to consider the representation of the petitioner positively and pass orders imposing necessary conditions as per the above said Government Order.
7. With the above direction, this writ petition is disposed of. No cost.
