PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India , to set aside the order and decree passed in C.M.A No.4 of 2013 dated 28.02.2014 on the file of the Principal District Court, Pudukottai reversing the order in I.A.No.675 of 2012 in O.S.No.254 of 2012 dated 22.01.2013 on the file of the Sub Court, Pudukottai For Petitioner : M/s.R. Paranjothi For Respondent : Mr.T.Amjadkhan

O R D E R

When the matter is taken up for hearing it is represented by the learned counsel for the respondent that the suit in O.S.No.254 of 2012 on the file of the Sub Court, Pudukottai has been dismissed for default and thereby nothing survives for further adjudication in this revision petition.

2. The learned counsel for the petitioner would submit that he has filed a petition to restore the suit in O.S.No. 254 of 2012 which has been dismissed for default.

3. In view of the fact that the suit is O.S.No.254 of 2012 has been dismissed for default, nothing survives for adjudication in this revision petition and thereby this Civil Revision Petition stands dismissed. No cost. However liberty is granted to the petitioner to file a petition to restore the Civil Revision Petition before this Court in the event of the suit in O.S.No.254 of 2012 being restored before the lower Court.
