The present Writ Petition has been filed by a beneficiary of the order passed by the third respondent in W.C.No.169 of 2009, dated 18.07.2012 seeking a Mandamus for recovering the said amount from the fourth respondent.
2. The learned Additional Government Pleader appearing for the respondents 1 and 2 submits that the principal amount of Rs.4,14,400/- (Rupees Four Lakhs Fourteen Thousand and Four Hundred only) has been recovered by the third respondent. In case, if any application is filed by the beneficiary for withdrawal, the same would be considered. However, it is the grievance of the petitioner that only the principal amount has been recovered and interest portion has not been recovered.
3. Considering the above said facts, this Court is inclined to pass the following order:
2/5
a. The petitioner is at liberty to file an application before the third respondent seeking disbursement, less the amount already recovered by the third respondent. On such application, the third respondent is directed to pass orders within a period of two weeks from the date of receipt of a copy of this order.
b. For recovering the interest portion of the amount, the third respondent is directed to initiate further proceedings within a period of four weeks thereafter.
4. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
