O R D E R

The petitioner is aggrieved by the impugned selection list dated 12.10.2021.

2. According to the petitioner, he has shown all the original certificates which includes the PSTM Certificate at the time of certificate verification conducted by the respondents on 13.08.2021. However, according to the respondents, as seen from the counter filed before this Court, the petitioner did not produce the PSTM Certificate with regard to the higher grade at the time of certificate verification on 13.08.2018.

3. The learned Special Government Pleader appearing for the second respondent would submit that on the last hearing date i.e., on 01.09.2025, he 2/6

placed on record the order of this Court in W.P.(MD).No.404 of 2020 batch, dated 16.03.2020 and would submit that, as seen from the said order, if a candidate does not produce the required certificate at the time of certificate verification, even though he possesses the required qualification, he is not eligible to be selected to the subject post. The learned Special Government Pleader also relied upon another Division Bench judgment of this Court dated 05.06.2025 passed in W.A.(MD).No.84 of 2019 batch, which has followed the earlier order, dated 16.03.2020 referred to supra.

On the last hearing date, i.e., on 01.09.2025, the learned counsel appearing for the petitioner sought further time to peruse the authorities relied upon by the learned Special Government Pleader appearing for the respondents referred to supra and sought time to argue the matter. In the light of the request made by the learned counsel appearing for the petitioner, this matter has been adjourned today 'for arguments'. Even today, the learned counsel appearing for the petitioner seeks further time to peruse the judgments and make his submissions. Since the judgments relied upon by the learned Special Government Pleader appearing for the respondents makes it clear that if a candidate does not produce the required certificate at the time of certificate verification, even though he possess the required qualification, he is not eligible 3/6

to be selected to the said post, the question of entertaining this Writ Petition does not arise. Admittedly, in the case on hand, the petitioner did not produce the PSTM Certificate with regard to the higher grade at the time of certificate verification on 13.08.2018. The petitioner has also not produced any evidence before this Court to substantiate that he had produced the PSTM Certificate to the respondents at the time of certificate verification on 13.08.2018.

5. In view of the settled law as per the aforesaid judgments of the Division Bench, this Writ Petition does not deserve any merit.
