ORDER

This Civil Revision Petition has been filed against the dismissal of the application filed by the petitioner/defendant, which was filed under Order 6 Rule 18 of CPC seeking amendment of the written statement in I.A.No.388 of 2014 in O.S.No.70 of 2013 on the file of District Munsif Court, Srivaikundam, Tuticorin District.

2. When the matter came up for hearing on 25.09.2019, the learned counsel for the respondent/plaintiff has submitted that during pendency of this Civil Revision petition, the suit itself has been disposed of and hence, nothing survives in this Civil Revision Petition. But, the learned counsel for the petitioner requested to grant time to get instruction.

3. Considering the aforesaid submissions, this Court has directed the Registry to call for a report from the District Munsif Court, Srivaigundam, Tuticorin District, with regard to the status of the suit in O.S.No.70 of 2013. Accordingly, the Registry called for a report from the concerned Trial Court. The learned Trial Court, by the letter dated 28.09.2020, has stated that the suit in O.S.No.70 of 2013 was disposed of on 26.09.2016 itself. https://hcservices.ecourts.gov.in/hcservices/

4. In view of the aforesaid facts, this Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
