When the matter is taken up for hearing today, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Criminal Original Petition and he has also made an endorsement to that effect.

2. Recording the submission made by the learned counsel appearing for the petitioner, this Criminal Original Petition is dismissed as withdrawn. However, liberty is granted to the petitioner to file appropriate petition before the appropriate authority. The period, during which, this petition was pending before this Court shall stand excluded for the purpose of limitation. Consequently, connected Miscellaneous Petition is closed.
