ORDER

Heard both sides.

2.The writ petitioner herein had availed loan from the first respondent. A memorandum of deposit of title deeds was executed in favour of the first respondent. It was registered as Document No. 2645/2017. The loan account has since been closed. The first respondent had also returned the original documents to the writ petitioner herein. However, the discharge certificate issued by the first respondent has not been registered. The petitioner is labouring under the impression that the first respondent is dragging on the matter. Hence this writ petition has been filed.

3.When the matter was taken up for hearing, the learned Standing Counsel for the first respondent submitted that since the earlier document was erroneously registered as receipt, the present discharge certificate is not being accepted for registration by the second respondent. 4.This is the issue between the writ petitioner and the first respondent. When the first respondent has issued discharge certificate and he is also ready to present the same, it is not for the registering authority decline to register the document. The first respondent states that he will present the discharge receipt before the second respondent on 24.10.2025. As and when the same is presented, the second respondent is directed to register the same without raising any technical objections. 5.This Writ Petition is allowed accordingly.
