Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, Writ of Mandamus, directing the 2nd respondent to make enquiry in petitioner appeal dated 16.07.2022 and directing the 5th respondent to cancel the sale deeds dated 13.07.2020 vide registered document No.2903/2020, 2904/2020 and sale deed dated 02.12.2020, vide registered document No. 6886/2020 registered before the 5th respondent by the 6 to 9th respondents and to consider petitioner representation dated 17.04.2023. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.
2. The petitioner's husband submitted a complaint dated 21.12.2020, before the District Registrar (Administration), Madurai North, for cancelling the petition mentioned documents. The said complaint was rejected. Aggrieved by the same, the petitioner filed an appeal before the Inspector General of Registration.
3. These appeals are normally disposed of by the Deputy Inspector General of Registration. In this case, the authority who originally passed 2/4
the order has been promoted as Deputy Inspector General of Registration, Ramanathapuram. Therefore, the appeal has been transferred to the file of Deputy Inspector General of Registration (Registration), Ramanathapuram.
4. The said authority is directed to dispose of the petitioner's appeal on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. The Deputy Inspector General of Registration, Ramanathapuram, shall issue notice to all interested parties, hold an enquiry and only thereafter dispose of the appeal.
