PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to receive the retirement benefit by including the incentive increments granted to the petitioner for acquiring higher educational qualification of M.Ed., degree in conformity with the order of the Hon'ble Division Bench made in W.A.(MD) No.1190 of 2016, dated 05.03.2018 and disburse the same to the petitioner and by considering the petitioner's representation preferred to the official respondents dated 02.02.2024 within the period that may be stipulated by this Court.

O R D E R

The present Writ Petition has been filed by a retired Secondary Grade Teacher seeking a Mandamus to revise the retirement benefits by including the incentive increments granted to the petitioner for acquiring higher educational qualification, namely, M.Ed., degree. To the said effect, the petitioner has sent a representation on 02.02.2024 to the second respondent herein. Since there is no response, the present writ petition has been filed. 2/5

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 3.

3. Considering the above said fact that the conferment of incentive increment was pursuant to the directions of this Court, this Court without expressing any opinion on merits, directs the second respondent to consider the representation of the writ petitioner, dated 02.02.2024 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
