Prayer in WP(MD)No.5158/2017 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Mandamus directing the Respondents to implement the order of the 1st Respondent in proceedings Ma.Ni.2/23023/2015 dated 28.09.2016 and settle the salary arrears with pay commission increments and all monetary retirements benefits with 12% interest to the Petitioner within the time frame fixed by this Hon'ble Court.

ORDER

The learned counsel for the respondents would submit that the entire retirement benefits have been paid even before the order in https://hcservices.ecourts.gov.in/hcservices/ 1/2

Cont.P.(MD)No.1279 of 2019 the writ petition, the same was not brought to the notice of this Court. However, a Writ Appeal was filed by the respondents in W.A. (MD)No.995 of 2019 setting out the details of payment. It is further stated that the Hon'ble Division Bench, after recording statements made, dismissed the Writ Appeal as no further orders are necessary. Aggrieved by the said dismissal, both the petitioner as well as the respondents have filed Review Applications in Rev.Apl. (MD)Nos.235 of 2019 and 256 of 2019 and the same are pending.

2. In view of the same, the Contempt Petition is closed, with liberty to the petitioner to reopen it after the disposal of the Review Applications.
