Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents No.1 and 2 to take legal action against the discrepancies held in the third respondent Narthamalai Primary Agricultural Cooperative Credit Society in Pudukkottai District in accordance with Tamil Nadu Cooperative Society Act.

ORDER

[Order of the Court was made by The Hon'ble CHIEF JUSTICE] The petitioner alleges the perceived mismanagement of funds by the third respondent. The petitioner complains that the petitioner's representations have gone unheeded.

2. Oftentimes, persons with a personal axe to grind against an official lodge complaints upon the official not falling prey to the inducements offered. It is possible that this is one such case. It is equally possible that the petitioner may be a public-spirited person and genuinely seeks action to be taken against corrupt officials.

3.However, the High Court in exercise of its authority under Article 226 of the Constitution will not go into the allegation of corruption or pore over convoluted accounts to asses the position. The petitioner is permitted to make a detailed, point-by-point representation to the second respondent Registrar, furnishing the particulars that would help the second respondent in appreciating the allegations. Such representation may be made within four weeks from date, whereupon the second respondent will communicate his prima facie views to the petitioner within six weeks of the receipt of the representation in terms of this order. 4.W.P(MD) No.19126 of 2021 is disposed of without any order as to costs.
