ORDER

The present Writ Petition has been filed seeking a Writ of Certiorarified Mandamus to quash the impugned order dated 22.08.2025 and consequently direct the respondents to issue a fresh patta in favour of the petitioner.

2.Mr.I.Pinaygash, learned counsel appearing for the State, accepts notice on behalf of the respondents.

3.The petitioner claims right over the property in old Survey Field No. 16/5, to an extent of 5 acres 1⁄2 cents, based on the sale deed 2/6

dated 08.03.2001. The petitioner has submitted an application for the issuance of patta. The respondent, after considering the same, rejected the application, which is impugned herein.

4.The contention of the petitioner is that, although the petitioner has purchased the property to an extent of 111⁄2 cents, he is in possession of 16 cents in that area, including 5 cents which is classified as "Boosthi." The petitioner is now seeking issuance of patta for 16 cents.

5.This Court is of the considered opinion that the petitioner is in occupation of 5 cents over which he has no entitlement. However, the impugned order, which completely rejects the issuance of patta, is incorrect. Therefore, the impugned order is quashed to the extent of denying patta for 111⁄2 cents and is sustained in respect of the remaining portion. The respondents are directed to issue patta in favour of the petitioner to an extent of 111⁄2 cents based on the sale deed. As far as the remaining 5 cents is concerned, the respondents may consider issuing a B memo to the petitioner and pass appropriate orders, after affording an 3/6

opportunity of hearing to the petitioner and any rival claimants, if any. The entire exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 6.With the above directions, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
